How Conciliation Works?
- Conciliation involves a neutral and unbiased conciliator who facilitates communication between the two parties having the dispute, with the aim of achieving a settlement or resolution.
- The parties in dispute need to agree to have recourse to a conciliation process.
- An independent conciliator is appointed after mutual agreement between the parties.
- The parties discuss the issues under dispute.
- The conciliator will provide his/her opinion after assessing the situation and the arguments brought forward and tabled by each party. The opinion of the conciliator may help to form a settlement or bring a conclusion to the dispute.
It should be noted that a conciliation process is entirely voluntary and a successful outcome depends on a mutual agreement. Either party may alternatively walk away from the process at any stage.
